CV2011-04980 Ria Ramgoolam and Others (the Claimants) -v- Shelly Street Allong also called Shelly-Ann Nardis and Donsil Holder (the Defendants)
Our firm represented the Claimants. On 19th November 2013 the court ordered that the Defendants vacate the lands owned by the Claimants and break down and remove the houses illegally built by the Defendants who were squatting on lands owned by the Claimants. In 2013 the Defendants filed an appeal. In 2018 the appeal was dismissed and the Defendants had to pay the Claimants’ costs. The Defendants still refused to break down and remove these houses so in 2020 the Claimants took the Defendants to court for contempt of court. In 2021 the court found Shelly Streete Allong to be in contempt of court for disobeying the order of this court made on 19th November 2013 and committed to the Women’s Prison Golden Grove, Arouca or such other facility under the jurisdiction of the Commissioner of Prisons to serve a term of seven (7) days simple imprisonment

CV2015-04120 Claudius Rodney and Rajanie Ramgattie (the Claimants) -v- Nathaniel Rodney also called Winford Nathaniel Rodney (the Defendant)
Our firm represented the Claimants. The Claimants were legally aided. The Defendant is the son of Claudius Rodney. On 8th June 2016 the Court ordered that the Claimants are entitled to possession of a property at Battoo Boulevard, Marabella which the Defendant continue to occupy despite the 3 notices to quit served by the Claimants on the Defendant. The Defendant was also restrained from threatening, assaulting, harassing, cursing and/or verbally abusing the Claimants. The Defendant filed an appeal on 13th July 2016. On 11th July 2017 the Defendant’s application for a stay of execution was dismissed by the Court of Appeal and the Defendant was to pay the sum of $6,500.00 to the Legal Aid Authority. The Claimants were free to move back into their property, but the Defendant refused to vacate. After our offices contacted the Marabella Police Station to assist the elderly Claimants, the Defendant was removed from the property. CV2017-04069 Nicole Patterson (Claimant) -v- Ronald Straker (Defendant)
Our firm represented the Claimant. The Claimant and the Defendant were in a cohabitational relationship during which time they purchased a property at Arima via a mortgage. In April 2016 the Claimant was physically abused by the Defendant which caused her to vacate the Arima property. From April 2016 to date the Claimant paid the mortgage instalments. In September 2016 the Claimant visited the Arima property and noticed the front door locked and the lawn overgrown. When she gained access to the property through the back door she discovered the property was trashed and all the furniture and appliances including her personal belongings like clothes, laptop and cellular phone were all missing. The Defendant denied he was in a cohabitation relationship with the Claimant. After hearing the evidence from both sides at the trial, the Court found favour with the Claimant. On 14th May 2019 the court ordered the Defendant to transfer his half share in the Arima property to the Claimant and to pay the sum of $50,000.00 representing the value of the missing items with costs to be paid by the Defendant.

CV2017-04406 Chanan Sudama and Chanan Sudama (the Lawful Attorney of Narine Mohindranath Sudama) (the Claimants) -v- The Water and Sewerage Authority of Trinidad and Tobago (the Defendant)
Our firm represented the Claimants. The Claimants’ property was damaged because of leaking water mains of the Defendant. The Defendant objected to the Claimant’s claim against them on the ground that the claim was filed outside the four (4) year limitation period and should be struck out. After hearing submissions from the Attorney at Law for the Claimants and the Defendant, the court dismissed the Defendant’s objection. The Claimants alleged that in June 2013 they constructed a retaining wall and expended sums of money in repairing the damage caused by the subsidence to their property. However, neither the Claimants nor the Defendant repaired the leaking water mains. The court held that the source of the nuisance, which was the leaking water mains continued and opined that ‘where there is a continuing tort, a fresh action accrues every day’.
